<title>APN Independent Practice Bill Signed Into Law</title>

<description><![CDATA[<p style="text-align: justify;"><span style="color: black; font-family: Helvetica, sans-serif; font-size: 10.5pt;">We want to share an important update: legislation expanding independent practice for advanced practice nurses has now been signed into law.</span></p> <p style="text-align: justify;"><span style="color: black; font-size: 10.5pt; font-family: Helvetica, sans-serif;">This marks a significant shift in New Jersey’s healthcare landscape. While we were able to secure important limitations in the final bill, including restricting independent practice to primary care, imposing a 5,000 in-specialty collaboration requirement, and requiring APNs to carry malpractice coverage and be held to the same malpractice standard of care as physicians, the law still represents a meaningful expansion of non-physician scope of practice.</span></p> <p style="text-align: justify;"><span style="color: black; font-size: 10.5pt; font-family: Helvetica, sans-serif;">Our focus now turns immediately to implementation. Regulatory decisions will determine how this law is carried out in practice, and MSNJ will be actively engaged at every step to push for strong safeguards, protect patient safety, and preserve the role of physician-led care teams.</span></p> <p style="text-align: justify;"><span style="color: black; font-size: 10.5pt; font-family: Helvetica, sans-serif;">At the same time, this effort is far from over. <title>MSNJ Update: Executive Order Extends APN Joint Protocol Waiver Until April 2</title>

This action continues a temporary policy that had been expected to sunset on February 16.</span></p> <p style="text-align: justify;"><span style="color: #403f42; font-size: 11.5pt; font-family: Arial, sans-serif;">MSNJ strongly disagrees with the rationale behind this extension. We support collaborative, team-based care, and this waiver does not expand access. Instead, it encourages fragmented practice models, not coordinated, physician-led teams. Physicians’ greater education, training, and diagnostic experience are linked to better outcomes and more cost-effective care. <title>Impact of Government Funding Shutdown on Medicare Telehealth</title>

<description><![CDATA[<p style="text-align: center;"><b><i><span style="font-size: 11.5pt; font-family: Arial, sans-serif; color: #403f42;">Medicare’s current telehealth flexibilities, including in-home, audio-only, and non-rural coverage, have expired, rolling back key gains physicians and patients have relied on since the COVID-19 public health emergency.</span></i></b></p>
<p style="text-align: justify;"><span style="font-size: 11.5pt; font-family: Arial, sans-serif; color: #403f42;">The AMA and MSNJ have long called for Congress to enact legislation that would:</span></p>
<ol>
    <li><span style="font-size: 11.5pt; font-family: Arial, sans-serif; color: #403f42;">Permanently allow Medicare patients to receive telehealth services by waiving the geographic restrictions in current law; and </span></li>
    <li> <span style="font-size: 11.5pt; font-family: Arial, sans-serif; color: #403f42;">Permanently allow Medicare patients to receive telehealth services in their homes instead of having to go to a medical facility to receive telehealth from a distant site.</span></li>
</ol>
<p style="text-align: justify;"><span style="font-size: 11.5pt; font-family: Arial, sans-serif; color: #403f42;">To date, however, Congress has passed legislation that only temporarily waives these requirements. Most recently, in March 2025 Congress extended these telehealth flexibilities for a six-month period that ended Sept. 30, 2025.</span></p>
<p style="text-align: justify;"><span style="font-size: 11.5pt; font-family: Arial, sans-serif; color: #403f42;">Physicians who provide telehealth services to Medicare patients should be aware that the current Medicare telehealth flexibilities have lapsed. This means that New Jersey patients would not be able to receive telehealth services in their homes. In addition, the ability to provide audio-only services to Medicare patients have lapsed, as well as the Acute Hospital Care at Home program.</span></p>
<p style="text-align: justify;"><span style="font-size: 11.5pt; font-family: Arial, sans-serif; color: #403f42;">In past government shutdowns, whenever Congress passed legislation to reopen the government, it made the funding and policies retroactive to the effective date of the shutdown. Physician practices may want to consider adjusting their patient schedules for telehealth services.</span></p>

<description><![CDATA[<p style="text-align: justify;"><strong><em>National Physician Suicide Awareness Day encourages individual and system action to better support physician mental health and wellbeing</em></strong></p><p style="text-align: justify;"><em><strong>Trenton, NJ</strong></em> — Today the Medical Society of New Jersey (MSNJ) honors National Physician Suicide Awareness Day (NPSA Day) to help shift the health care system from one where physicians think burnout, depression or suicidal thoughts are something they must overcome by themselves to one where they see the support system around them. As a NPSA Day Supporting Organization, MSNJ is spreading awareness of the resources available to physicians in desperate need. </p><p style="text-align: justify;">Physicians have one of the highest suicide rates of any profession. More than half of physicians know a physician who has either considered, attempted or died by suicide in their career, and it is estimated that a million Americans lose their physician to suicide each year. </p><p style="text-align: justify;">While there are some signs of improvement, the overall state of wellbeing remains low - with residents and medical students reporting an even lower state of wellbeing. </p><p style="text-align: justify;">• For the fifth year in a row, more than half of physicians still report they often have feelings of burnout, compared to four in ten before the pandemic in 2018. </p><p style="text-align: justify;">• More than one-third (34%) of physicians felt hopeless or that they have no purpose. </p><p style="text-align: justify;">• Nearly half of physicians (46%) report withdrawing from family, friends, and co-workers. </p><p style="text-align: justify;">These feelings can lead to burnout and, when left untreated, can cause more cases of depression, anxiety, post-traumatic stress disorder (PTSD) and lead to suicidal thoughts for physicians, directly impacting physician suicide rates.</p><p style="text-align: justify;">However, physicians, residents and students have identified solutions they need to improve their mental health and wellbeing. Dr. Blumenthal has been a member of MSNJ since 1978 and a member of MSNJ’s Board of Trustees since 2016, having served on various councils and committees. Dr. Blumenthal will assume the presidency from David E. Swee, MD.</span></p> <p style="text-align: justify;"><span style="color: #000000;">“We are excited to welcome Dr. Blumenthal as our incoming President for the 2025-2026 term,” said Larry Downs, CEO of MSNJ. “Dr. Blumenthal brings a keen eye toward critical public health issues and a fresh perspective that will benefit our members and the broader medical community. We look forward to advancing our initiatives with him this year.”</span></p> <p style="text-align: justify;"><span style="color: #000000;">In his inaugural speech as President, Dr. Blumenthal shared a few principles that will guide him during his presidency:</span></p> <p style="text-align: justify;"><b style="color: #000000;">1. Elbow room for physicians.</b></p> <p style="text-align: justify;"><span style="color: #000000;"><span style="color: #000000;">“We must create space for physicians to practice medicine without the burden of intrusive or misguided regulations. Common sense and humanity must prevail. One clear example is the movement to remove stigmatizing questions about mental health from licensing and credentialing applications. </span>These questions discourage physicians from seeking the help they may need. Safe Haven laws—such as the model adopted in Virginia—eliminate this barrier. I believe strongly that <i>‘some people are physicians, but all physicians are people.’ </i>We owe it to each other to create a system where seeking help is a sign of strength, not a liability.”</span></p> <p style="text-align: justify;"><b style="color: #000000; text-align: left;">2. Fair payment for services.</b></p><p style="text-align: justify;"><span style="color: #000000;"> “We cannot care for vulnerable populations—especially Medicaid patients—under the current fee structure. Consider:</span></p> <ul style="list-style-type: disc;"> <li style="text-align: justify; line-height: 115%;"><span style="color: #000000;">New Jersey has 9.5 million residents.</span></li> <li style="text-align: justify; line-height: 115%;"><span style="color: #000000;">About 1.3 million (13.5%) are covered by Medicare.</span></li> <li style="text-align: justify; line-height: 115%;"><span style="color: #000000;">1.9 million (20.4%) are covered by Medicaid.</span></li> <li style="text-align: justify; line-height: 115%;"><span style="color: #000000;">Nearly 40% of all births are covered by Medicaid.</span></li> </ul> <p style="text-align: justify;"><span style="color: #000000;">We’ve spoken out against the 2.8% Medicare cut that took effect this January. But I submit to you: it’s time to be equally forceful about Medicaid. This is the benefit that provides essential care—including mental health care—for our poorest patients. I know some worry that pushing too hard here might backfire. But I challenge us all with the question: ‘<i>What would you do if you were not afraid?’”</i></span></p> <p style="text-align: justify;"><b style="color: #000000;">3. Reform that puts clinicians first.</b></p><p style="text-align: justify;"><span style="color: #000000;"> “We achieved a major milestone when Governor Murphy signed prior authorization reform into law in 2024. Our next steps must include meaningful Step Therapy reform and policies that promote <b>team-based care</b>—always led by a physician. That leadership is essential to maintaining safety, quality, and continuity.”</span></p> <p style="text-align: justify;"><b style="color: #000000;">4. A more medically literate public.</b></p><p style="text-align: justify;"><span style="color: #000000;"> “Enhancing patient understanding is a personal mission of mine. In my office, pamphlets and visual aids help build that bridge. I would like to see our AMA collect and publish the excellent “JAMA Patient Pages” in a public-facing, searchable format. As the late retail innovator Sy Syms used to say, <i>“An educated consumer is our best customer.”</i> Likewise, an educated patient is our best partner.</span></p> <p style="text-align: justify;"><span style="color: #000000;">I believe deeply in the “partners in recovery” model. When patients understand their conditions and treatments, they become collaborators in their own care.”</span></p> <p style="text-align: justify;"><span style="color: #000000; text-align: justify;">Dr. Blumenthal, a senior occupational medicine physician, brings a wealth of experience in pharmacology, toxicology, and trauma care. His expertise in managing work-related injuries and illnesses is backed by his fellowship training in clinical pharmacology and toxicology, alongside 12,000 hours as an emergency physician. Since 1993, Dr. Blumenthal has performed over 37,000 independent medical examinations, including long-term disability assessments.</span></p> <p style="text-align: justify;"><span style="color: #000000;">Dr. Blumenthal earned his medical degree from the University of Bonn in Germany, where he also completed his doctoral thesis in biochemistry. He furthered his training in clinical pharmacology at Tulane University and clinical pharmacokinetics at SUNY Buffalo, before obtaining his Master of Public Health from Rutgers University's EOHSI program. He continues his academic contributions as a Clinical Assistant Professor of Medicine at Rutgers New Jersey Medical School and regularly lectures at legal education seminars.</span></p> <p style="text-align: justify;"><span style="color: #000000;">Dr. Blumenthal's research led to the first published measurement of nitroglycerin plasma concentrations in humans. He is board-certified in Occupational Medicine by the American Board of Preventive Medicine, is a certified Independent Medical Examiner and also a certified Medical Review Officer. <title>MSNJ Takes Action to Prevent Physician Suicide</title>

<description><![CDATA[<p style="text-align: justify;"><b>National Physician Suicide Awareness Day encourages individual and system action to better support physician mental health and wellbeing</b></p> <p style="text-align: justify;">Trenton, NJ — Today, the Medical Society of New Jersey (MSNJ) honors National Physician Suicide Awareness Day (NPSA Day) a reminder and a call to action, so that physicians’ struggles don’t become mental health emergencies. As a NPSA Day Supporting Organization, MSNJ is sharing resources with members. </p> <p style="text-align: justify;">Physicians have one of the highest suicide rates of any profession. More than half of physicians and medical students, and nearly half of residents know of a physician or colleague or peer, respectively, who has ever considered, attempted or died by suicide.</p> <p style="text-align: justify;">While there are some signs of improvement, the overall state of wellbeing remains low – with residents and medical students reporting an even lower state of wellbeing.</p> <ul><li style="text-align: justify;">For the fourth year in a row, six in ten physicians often have feelings of burnout, compared to four in ten before the pandemic in 2018.</li><li style="text-align: justify;">Seven in 10 medical students and 6 in 10 residents often have feelings of burnout.</li><li style="text-align: justify;">Nearly two-thirds of medical students report withdrawing from family/friends/co-workers, as well as 54% of residents and 38% of physicians.</li></ul>   <p style="text-align: justify;">Burnout and barriers to care for current and future physicians can cause more cases of depression, anxiety, post-traumatic stress disorder (PTSD) and lead to suicidal thoughts for physicians, directly impacting physician suicide rates.</p> <p style="text-align: justify;">However, physicians, residents and students have identified solutions they need to improve their mental health and wellbeing. Now is the time to get mental health resources in the hands of current and future physicians, to remove intrusive mental health questions from licensing and credentialing applications and to take action to create a culture of wellbeing in medical schools, residency programs and workplaces.</p> <p style="text-align: justify;">MSNJ is proud to support this outstanding initiative. Whatever the future brings, I will continue to work to make MSNJ the most effective and supportive organization for our physician colleagues.”</span></p> <p style="text-align: justify;"><span style="font-size: 14px; font-family: Arial; color: #000000;">Dr. Swee is Emeritus Professor and Immediate Past Chairman of the Rutgers Robert Wood Johnson Medical School Department of Family Medicine and Community Health. He served as an Associate Dean for Faculty Affairs at RWJMS from 2011 to 2019.</span></p> <p style="text-align: justify;"><span style="font-size: 14px; font-family: Arial; color: #000000;">Dr. Swee is a graduate of Dalhousie University’s Faculty of Medicine and of the family medicine residency at Somerset Medical Center, and he is board certified in family medicine. From 2002 to 2003, he completed the F. Marian Bishop Fellowship in conjunction with the American Council on Education Fellowship Program. For the school, he was Chairman of the Department of Family Medicine for 15 years, of the school’s Curriculum Committee for nine years, and of the school's faculty practice group for two years. He was also the Associate Dean for Education from 2005 through 2016 and the Associate Dean for Faculty Development from 2011 to 2016. He has served in many other departmental roles such as Director, Predoctoral Programs; Director, Fellowship Programs; and Chair, Appointments and Promotion Committee. <title>Congressional Update: Action Needed to Fix Medicare</title>

The fiscal stability of physician practices and the long-term viability of our nation’s entire health care system hang in the balance.</span><br /></p> <p style="text-align: justify;"><span style="font-family: Roboto;">New Jersey doctors have stated loud and clear they’re outraged over recent Medicare payment cuts, which come when the state’s physicians are already grappling with burnout in an overwhelmed healthcare system. These cuts will also exacerbate disparities in healthcare access and further jeopardize the well-being of patients </span><i style="font-family: Roboto;">and</i><span style="font-family: Roboto;"> physicians in New Jersey.</span><br /></p> <p style="text-align: justify;"><span style="font-family: Roboto;">Medicare payment reform is the first pillar of the </span><span style="font-family: Roboto;"><a href="https://urldefense.proofpoint.com/v2/url?u=https-3A__www.ama-2Dassn.org_amaone_ama-2Drecovery-2Dplan-2Damerica-2Ds-2Dphysicians&amp;d=DwMFaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=eBqAo7Lb24YoMi90TweMDsaUFqIKw2fmbCZ1iXVG5fA&amp;m=bjgE5DV6q0mmiuCi4glt5nCGG2veiJ9zk5qeBpPmDU9TbW4yqHCWHUJ7PB7WJ5Ci&amp;s=zedtYCeEC6_oLzmvZIcXXwVpkDPNjUCGHKNyWjldMMo&amp;e=">AMA Recovery Plan for America’s Physicians</a></span><span style="font-family: Roboto;">. Our needs include immediate relief from annual funding cuts and fundamental changes to Medicare reimbursement centered on simplicity, predictability, relevance and alignment, principles first outlined in </span><span style="font-family: Roboto;"><a href="https://urldefense.proofpoint.com/v2/url?u=https-3A__www.ama-2Dassn.org_practice-2Dmanagement_medicare-2Dmedicaid_principles-2Dmedicare-2Dphysician-2Dpayment-2Dreform&amp;d=DwMFaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=eBqAo7Lb24YoMi90TweMDsaUFqIKw2fmbCZ1iXVG5fA&amp;m=bjgE5DV6q0mmiuCi4glt5nCGG2veiJ9zk5qeBpPmDU9TbW4yqHCWHUJ7PB7WJ5Ci&amp;s=g7wXFKirxvKY33uhVwvRackE6Yxa6fMFEkzbEr3oyio&amp;e=">reform principles</a></span><span style="font-family: Roboto;"> issued last fall.</span><br /></p> <p style="text-align: justify;"><span style="font-family: Roboto;">The current Medicare physician system reflects none of those principles, which needs to change. The government’s own Medicare Economic Index (MEI), which gauges the inflation in medical practice costs, will hit 4.5% in 2024, its highest level in two decades.</span><br /></p> <p style="text-align: justify;"><span style="font-family: Roboto;">When combined with the 3.8% hike in the MEI recorded in 2023, that means medical practice costs increases will have exceeded 8 percent over just two years. Many individual and group physician practices have experienced cost increases well beyond this level, while still seeking a full recovery from pandemic-related setbacks.</span><br /></p> <p style="text-align: justify;"><span style="font-family: Roboto;">However, provisions in current law required the Centers for Medicare &amp; Medicaid Services to implement a 2%, across-the-board reduction in Medicare physician payment rates this year, with another 3.36% cut to the conversion factor scheduled for 2024. In stark contrast to the annual payment increases tied to inflation given to hospitals, skilled nursing facilities and other entities that bill Medicare, physician practices have fought to reduce or delay payment cuts nearly every year.</span><br /></p> <p style="text-align: justify;"><span style="font-family: Roboto;">Taking inflation into account, Medicare physician payment rates fell 26% from 2001 to 2023, while practice costs rose by 47% over the same period. We must place physician practices on sound financial ground through Congressional action to fix the Medicare physician payment system.</span><br /></p> <p style="text-align: justify;"><b style="font-family: Roboto;">Legislative relief</b><br /></p> <p style="text-align: justify;"><span style="font-family: Roboto; font-size: 14px;">The AMA is strongly supporting the Strengthening Medicare for Patients and Providers Act (<span><a href="https://urldefense.proofpoint.com/v2/url?u=https-3A__www.congress.gov_bill_118th-2Dcongress_house-2Dbill_2474&amp;d=DwMFaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=eBqAo7Lb24YoMi90TweMDsaUFqIKw2fmbCZ1iXVG5fA&amp;m=bjgE5DV6q0mmiuCi4glt5nCGG2veiJ9zk5qeBpPmDU9TbW4yqHCWHUJ7PB7WJ5Ci&amp;s=ethehRcYRtUOoeN3lh-AAB0ycN4jxYUJIccL7DkPKlQ&amp;e=">H.R. 2474</a></span>), a bipartisan measure now pending in the 118<sup>th</sup> Congress, which would provide the crucial link between the Medicare physician payment schedule and the MEI, and finally put physicians on an equal fiscal footing with other entities drawing Medicare payment. Jackson, which overturned Roe v. Some of my priorities include:</span></p> <ul style="list-style-type: disc;"><li style="text-align: justify;"><span style="font-family: Roboto; font-size: 14px; color: #000000;">Further examining the prior authorization process, so that physicians can concentrate on delivering quality care and patients can receive the treatments they need without having to go through any hurdles.</span></li><li style="text-align: justify;"><span style="font-family: Roboto; font-size: 14px; color: #000000;">Improving the physician workforce in New Jersey by working collaboratively with the Legislature and other stakeholders to improve the licensure process and loan forgiveness programs.</span></li><li style="text-align: justify;"><span style="font-family: Roboto; font-size: 14px; color: #000000;">Promoting team-based care, with physicians leading the team, to ensure that patients receive the top-quality care they deserve.</span></li><li style="text-align: justify;"><span style="font-family: Roboto; font-size: 14px; color: #000000;">Advocating for easier, quicker technology adoption in medical practices and healthcare institutions across the state, so that physicians who are interested in electronic medical records (EMR) systems and electronic health information exchanges (HIE) can easily implement and utilize them.”</span></li></ul> <p style="text-align: justify;"><span style="font-family: Roboto; color: #000000;">Dr. Orland is a board-certified urologist with New Jersey Urology, A Summit Health Company.
